Terms of use
Draft for review by a qualified UK solicitor. These terms are not yet in force, and the words in square brackets still need filling in.
Last updated: [EFFECTIVE DATE]
1. About these terms
These terms are the agreement between you and [COMPANY NAME], the company that makes Kur8. We're registered in England and Wales under company number [COMPANY NUMBER], and our registered office is [REGISTERED ADDRESS]. In these terms, "we", "us" and "our" mean [COMPANY NAME], and "you" means the person using Kur8 or, in parent mode, the parent or guardian who set it up.
Please read them before you use Kur8. They explain what Kur8 does, what it can't do, how subscriptions work, and your rights. Our privacy notice explains how information is handled, and it's part of the agreement too.
If you have a question or a complaint, email us at hello@getkur8.app. We aim to reply within 5 working days.
2. Who can use Kur8
- For yourself. You must be 18 or over to use Kur8 for yourself and to buy a subscription.
- For your child. A parent or guardian with parental responsibility can set Kur8 up in parent mode on the phone of a child aged 13 to 17. You agree to these terms for yourself and on your child's behalf, and you're responsible for how Kur8 is used on that phone.
- Not for under-13s. Kur8 isn't for children under 13. Instagram, Facebook, TikTok, YouTube, X and Snapchat don't allow accounts for them either.
Kur8 is for personal use. It isn't for use by businesses, schools or employers to manage other people's phones.
3. What Kur8 does
Kur8 opens the mobile websites of Instagram, Facebook, TikTok, YouTube and X inside the app, so you can use your own accounts with fewer distractions. It can:
- hide kinds of posts you choose not to see, such as short videos, paid partnerships or AI-generated content
- hide posts from accounts you choose
- count your time and the posts or videos you see, and pause a channel when you reach a limit you set
- share one daily allowance across your channels
- in parent mode, let a parent set limits behind a PIN and see a summary of totals
Once Apple's Screen Time features are added, Kur8 can also limit the platforms' own apps on your phone, including Snapchat, and YouTube Kids on a child's phone.
4. What Kur8 can't do
We work hard to make Kur8 useful, but please understand its limits.
- Filters aren't perfect. Kur8 hides posts by reading the labels and text the platforms put on them, such as "Paid partnership". If a post isn't labelled, or a platform changes its pages, Kur8 may miss it or hide something by mistake. We don't promise that any filter will catch everything.
- The platforms' own ads stay visible. Kur8 never hides anything a platform labels as an ad or sponsored, and there's no setting to change this.
- Suggested limits aren't expert advice. The starting limits Kur8 suggests, including the ones by age in parent mode, are our suggested starting point. They aren't medical, psychological or parenting advice. Choose what's right for you or your family.
- Parent mode isn't a guarantee. A child can still delete Kur8, or remove its Screen Time access in iPhone Settings, and could use another device. Kur8 tells the parent when it notices limits were switched off, but it can't prevent it. Parent mode supports conversations and supervision. It doesn't replace them.
- It depends on the platforms. Kur8 works with websites we don't control. A platform may change its site, limit what works inside other apps, or stop a feature working. Section 6 explains what happens then.
5. The platforms
Kur8 isn't made by, endorsed by or connected with Meta (Instagram and Facebook), TikTok, Google (YouTube), X Corp. (X) or Snap (Snapchat). Their names and logos belong to them. Kur8 shows each platform's logo only to tell you which service a channel opens.
- Your accounts stay yours. You sign in on the platform's own page. Kur8's code doesn't run on sign-in, account, password or message pages. Kur8 never sees, keeps or sends your password or sign-in details for any platform. The only login Kur8 keeps is your Kur8 account.
- Their terms still apply. When you use a platform through Kur8, you're still using that platform, and its own terms and privacy policy apply. You're responsible for following them.
- Kur8 never acts for you. It doesn't like, comment, follow, post, message or scroll on your behalf, and it doesn't collect information from the platforms in the background.
- Their content isn't ours. We don't check, control or take responsibility for what people post on the platforms. If you see something harmful, use the platform's own reporting tools.
6. Changes to Kur8 and to channels
We'll keep improving Kur8, and we may change how features look or work. We won't make changes that make Kur8 significantly worse for you during a subscription period you've paid for, unless a platform or the law leaves us no choice.
If a platform blocks Kur8 or changes its site so that a channel can't work, we'll try to fix it quickly. If we can't, we may have to remove that channel. If losing a channel means Kur8 is no longer what you paid for, you can cancel, and you can ask us at hello@getkur8.app for a refund for the unused part of your subscription.
7. Subscriptions
Kur8 needs a subscription. You can choose:
- Monthly: £4.99 a month
- Yearly: £29.99 a year
Prices include VAT. You buy and manage your subscription through Apple's App Store, using your Apple Account, and Apple takes the payment.
It renews automatically. Your subscription renews at the end of each month or year, and Apple charges you, unless you cancel at least 24 hours before the renewal date.
Cancel any time. Cancel in your iPhone's Settings: tap your name, then Subscriptions, then Kur8. Kur8 keeps working until the end of the period you've paid for.
What a subscription covers. One subscription covers one adult and one child: Kur8 on one phone for you, and in parent mode on one phone for your child, both signed in to your Kur8 account. A second child needs their own Kur8 account and subscription. The subscription isn't shared through Apple's Family Sharing.
Price changes. If we change the price, Apple will tell you before it applies, and you can cancel before you're charged the new price.
Restore purchase. If you get a new phone or reinstall Kur8, use Restore purchase on the subscription screen.
Free trial. If you're new to Kur8, your subscription starts with 14 days free. Apple won't charge you until the trial ends, and then charges the price of the plan you chose, unless you cancel at least 24 hours before the trial ends. Cancel in the same place as above. The free trial is offered once per Apple Account; if you've had it before, you're charged from the start.
8. Your right to cancel and get a refund
Under the Consumer Contracts Regulations, you normally have 14 days from buying a subscription to change your mind. Because you buy through the App Store, refunds are handled by Apple. To ask for one, go to reportaproblem.apple.com or contact Apple Support. If you have trouble, email us at hello@getkur8.app and we'll help.
When you start using Kur8 straight away after buying, you ask us to begin providing it within the 14 days. Apple's own policies decide how much of a refund you get if you cancel during that time.
9. Your rights under consumer law
Nothing in these terms takes away your legal rights. Under the Consumer Rights Act 2015, Kur8 must be of satisfactory quality, fit for purpose, and as we've described it. If it isn't, you can ask us to fix it, and if we can't fix it within a reasonable time and without significant inconvenience to you, you can ask for some or all of your money back.
If faulty digital content we've supplied damages your phone or other digital content you own, and that's because we didn't use reasonable care and skill, we'll either repair the damage or pay you compensation.
For more about your rights, contact Citizens Advice at citizensadvice.org.uk, or Advice Direct Scotland if you live in Scotland.
10. Using Kur8 fairly
Please don't:
- use Kur8 to watch or control another adult's phone, or to monitor anyone without them knowing
- use parent mode for any child you aren't the parent or guardian of, or hide from your child that Kur8 is set up
- copy, change, take apart or reverse-engineer Kur8, except where the law allows it
- use Kur8 to break a platform's terms, to collect information from the platforms, or to do anything illegal
- try to get round a subscription, or sell or share your Kur8 account
If you seriously or repeatedly break these rules, we may stop providing Kur8 to you. If you have a subscription and we end it for this reason, we'll tell you why.
11. Parent mode
If you set up parent mode, you confirm that you're the child's parent or guardian, and that the child is aged 13 to 17.
- Tell your child. Kur8 shows your child a notice saying it was set up by a parent and what you can see. You can't switch this notice off. Please go through Kur8 with your child when you set it up.
- What you see is totals only. The activity summary shows time, counts and changes. It never shows which accounts, posts, comments or messages your child looked at or wrote.
- Keep your PIN safe. Your PIN and recovery code are the only way into parent controls. We can't see them and can't reset them for you. If you lose both, you'll need to delete and reinstall Kur8, which removes its settings and history.
- Your child's welfare is yours to judge. Kur8 is a tool to help families. It's not a safety service, and we don't monitor anyone. If you're worried about your child's safety, contact the right people, such as the NSPCC on 0808 800 5000, or the police in an emergency.
12. Our licence to you
Kur8 and everything in it, apart from the platforms' content and logos, belongs to us or the people who license it to us. We give you a personal, non-exclusive, non-transferable licence to use Kur8 on Apple devices you own or control, as Apple's App Store rules allow, for as long as you keep to these terms. "Kur8" and the Kur8 logo are ours, and you can't use them without our permission.
13. Our responsibility to you
- What we're responsible for. If we break these terms or don't use reasonable care and skill, we're responsible for loss or damage you suffer that's a foreseeable result. Loss is foreseeable if it's obvious it would happen, or if we both knew it might happen when you agreed to these terms.
- What we're not responsible for. We're not responsible for loss that isn't foreseeable, for business losses (Kur8 is for personal use), or for what a platform decides to do, such as changing its site, suspending your account, or the content people post, unless that's caused by us breaking these terms.
- What we never limit. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit, including your rights under the Consumer Rights Act 2015.
14. Apple
These terms are between you and us, not Apple.
- Apple isn't responsible for Kur8 or its content, and has no duty to provide maintenance or support for it.
- If Kur8 doesn't meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for it. Apart from that, and as far as the law allows, Apple has no other warranty obligation for Kur8.
- We, not Apple, are responsible for dealing with any claim about Kur8, including product liability, failing to meet legal or regulatory requirements, consumer protection and privacy law, and any claim that Kur8 or your use of it infringes someone else's intellectual property.
- You confirm that you're not in a country subject to a UK or US government embargo, or on a UK or US government list of restricted parties.
- Apple and its subsidiaries can enforce these terms against you as a third party.
15. Ending our agreement
You can stop using Kur8 at any time. To stop paying, cancel your subscription as section 7 explains. Deleting Kur8 doesn't cancel your subscription.
If we decide to stop providing Kur8 altogether, we'll give you at least [30] days' notice in the app and, for anyone with a subscription, we'll refund the unused part of what you've paid.
16. Changes to these terms
We may update these terms, for example to reflect a change in the law or in how Kur8 works. If a change matters, Kur8 will ask you to read and agree to the new terms before you carry on. If you don't agree, you can cancel your subscription, and if the change affects you significantly during a period you've paid for, you can ask for a refund for the unused part.
17. Complaints and the law
If you're unhappy, please email us at hello@getkur8.app first, and we'll try to put it right.
These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts where you live.
18. Other things
- If a court decides part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- We may transfer this agreement to another organisation, for example if Kur8 is sold. We'll tell you, and your rights won't be reduced. You can't transfer it without our agreement.
- Apart from Apple, as section 14 explains, nobody else has rights under these terms.
